Sutherlin man gets fifth D.U.I.I. conviction

ROSEBURG - A Sutherlin man who has been convicted 4 times previously, of driving under the influence of intoxicants, has now been convicted a 5th time.

David Phelps is accused of driving with nearly twice the legal limit of alcohol in his system, when his '96 Ranger pickup crashed into a tree on Nonpariel Road about 9 miles east of Sutherlin.

48-year old Mark Oliver died in the accident. Phelps and Oliver's 10-year old son were both had to extricated from the vehicle, and were taken to a Portland hospital.

Phelps testified Friday morning in Judge George Ambrosini, and told the 12-person jury "There's nothing I can say to express how bad I feel about this."

The jury deliberated less than two hours Friday afternoon before coming back with a guilty verdict for manslaughter-1, assault-3 and driving under the influence of intoxicants.

Phelps was convicted in 1984, again in 1988, a third time in 1996, and a fourth time in Lane County in 2000. Three of those times he attended Victims Impact Panels.

Phelps faces a minimum of 10 years in prison for manslaughter and up to 3 more years for the other charges.

A sentencing hearing is set for next week in Judge Ambrosini's courtroom.
