One defendant in Omann murder case to spend life in prison

ROSEBURG, Ore. -- A Days Creek teenager has been sentenced to prison for his part in the killing of a Canyonville man in September of 2007.

Judge Joan Seitz on Monday afternoon sentenced Charley Carnes, 19, to life in prison with the possibility of parole after a 25-year minimum for cutting the throat of Kevin Omann, after the Canyonville man had been hit in the head with an axe.

Family members spoke to the judge and talked about the grief and stress they have been through after losing Kevin Omann to the horrendous death, and urged the judge to sentence Carnes to mandatory life in prison.

But, prosecuting attorney David Hopkins said that under Oregon law, for a straight murder conviction, the judge had no choice. "This individual is going to sit in custody for 25 years, and his family will have access to him, he doesn't just disappear completely from their lives. And, there's always the possibility that he could be reunited with them should the criteria be found that he should be released. The Omanns don't have that luxury. Their son is gone."

Carnes spoke to the court and said he was sorry for all the grief he caused the Omann family and his own family.

Carnes' attorney argued in the trial that Omann was already dead before he acted. Judge Seitz did not agree with that and convicted him on the murder charge.

The co-defendant in the case, Austin Clark, is set to go on trial early next year.
