War hero's killer back in Roseburg

ROSEBURG, Ore. -- The man who killed a Douglas County war hero in a home invasion robbery is back in the county jail after his death penalty conviction was overturned in 2011.
Jesse Fanus, now 33, was sentenced to death in May of 1999, for killing war hero Major General Marion Carl.
His death sentenced was overturned in December of 2011 by a Marion County judge.
Fanus was 18-years-old when he broke into the Carl's home on Northbank Road and killed the Marine Corps hero.
Fanus shot Marion and stole money and a vehicle from the Carl family, and was later found and arrested in southern California.
Carl was one of the nation's most highly decorated World War II heroes for shooting down two
Japanese planes during the Battle of Midway, and 11 in the battle for Guadalcanal.
Fanus appealed his death penalty sentence and Marion County Judge Pamela Abernethy ruled that Fanus's attorney did not adequately represent him during the penalty phase when a jury decided he should get the death penalty.
Fanus was brought into the Douglas County Jail just after 3:00 p.m. on Tuesday.

Even in this pic he shows no remorse or feeling. I can't believe we are wasting tax payers money on this worthless scum. I'm sickened by this whole thing. I just hope one day justice is finally served to him....
This story really bugs me cause I remember getting high and stupid as hell with Jesse out in Glide. And all these years later I look at myself and everyone else that was that high and even higher and not a single one of us other than him have hurt let alone killed anyone ....... Jesse was well aware of what the hell he was doing and he chose to do the WRONG thing. He doesn't deserve to be back in court and to me it is a full disrespect to the victim's family .....
They shouldn't have let him sit in prison this long on the taxpayers dime. He should have been put to death when they caught him after killing that man. Criminals get more rights than the victims do and that needs to change in our society. he should not be able to live for 24 years on someone elses dime.
This is the problem as far as criminals go in this country...The sentences should be upheld, not changed because they had a bad childhood, the cheerleaders wouldn't go out with him, etc. That is, always was, and always will be BS.
If I were not adequately represented I would use the appeals process too. This case affected so many people! My heart goes out to those people.
They should put him back in the State Pen and do the family and the victim justice by upholding what the jury wanted. To bad he had a bad lawyer it happens, move on. He is guilty of killing a War Hero and a little old man. If he gets out and comes into my house the least of his worries would be a bad lawyer. The justice system is not just.
This guy and his father lived next door to my family for years. They are both completely psycho. Built treehouses on a dead end road and loaded the property with assault rifles, booby traps and were both doing meth when I was growing up. The police wouldn't go on the property when they were called. PSYCHOS. Came to our house and tried to break in ONE time. A gun in the face and fired at his feet all the way over the fence kept him out. I am thankful my dad had a loaded gun or my whole family could have been dead because of this crazy Fanus family. He has always been crazy and those eyes actually look mellow compared to what I have seen them look like. PLEASE DON"T RELEASE THIS PSYCHO BACK INTO SOCIETY. HE WILL NOT GET BETTER. Keep him locked up and keep the community safe please.

David Sunderland- I don't know much about this case, nor do I know much about either man Involved. But, you asked Bud if he knew them? You asked Bud if he knew what was going through their minds? And finally, if you broke into his house and he came at you with a gun, would you have the right to protect yourself? -The answer is you have NO RIGHT to break into someone's home and even LESS right to MURDER the person attempting to protect that home. Regardless of circumstance, which in this case I don't know much about, the beginning of that question ("if I broke into your home unarmed") kinda speaks for itself. Do people break into homes with good intention? The actual fact of the matter is that he murdered someone. I think we can agree that is wrong and he should be punished.
Ugh. I remember this all too well. Jesse was a mess. I joined the Navy the following year. I hadn't even remember this tragedy. :(

An eye for an eye is how things use to be ruled but now things are different and look where and what we deal with in such a small community.... Drug crimes, rape, murder, and etc maybe we should go back to how it use to be handled and set an example for the law breakers???
Brooke Olson he has been in prison, he has been brought back to county due to an appellate court ruling which resulted in a new sentencing trial. After the trial he will be transported out again.
My only question here is...didnt we just see a situation in our town where a young child was killed during the act of rape,a felony, and no talk took place around death penalty at all. But when a decorated retired veteran is killed that is the first thing everyone asks for. I am not stating my opinion about this case either direction (and I know the case well) just stating my frustration with the system and how backwards that seems.
He was in prison.... his sentence was overturned. He was transferred BACK to the DC Jail. When he has his new sentencing, he will go BACK to prison.........
I just have to comment in this. I lived on the road he commited the awful crimes on. Just the summer before i was lucky to meet Mr and Mrs Carl. They came to a yard sale we were having. they were the most polite and generous people id ever met. Mr. Fanus deserves to be killed. He should be exucted the way he killed Mr. Carl. I have been terrified ever since this has happend that he was going to come back to our road. Theres some other things that has happend that I can put him in that area around that time on that same road. . He did commit these hanus acts and he needs to be taken care of for this. He doesnt need to be in douglas county. he needs to be in a body bag. 6 feet under!

I think if it's an aggravated murder or with a motive to go out and actually kill someone intentionally, they should be put to death. Being a tax payer now, I don't want the money that I worked for to go to someone who stooped so low. I think that should be for all across America. But that's my opinion..
Mary Thomson, you are right he was disturbed as a child... I am glad that his Grandma has passed so she wouldn't have to deal with this anymore... Mandy Vanassche-Roach and I saw him the day after he killed Mr. Carl and he told us that he was going to be in the paper VERY SOON... He was bragging about something so terrible... However, when he was young I did feel sorry for him and his brother due to their home life... Jesses Grandma tried to get those boots on the straight and narrow... However, it just didn't work out... Even though I grew up around Jesse, he did a horrible thing, ruined and tore families apart and for that he should suffer the consequences...

The sentence was overturned, so he was sent back for re-sentencing proceedings. He deserves the worst we have to offer.
Jen, I believe it. I remember them saying in the juror room he had a effd child hood but I'm sure drugs had no part in it
Looks like they are going to re-sentence him due to his "poor" representation. My husband took Jesse down one time when he caught him stealing from the store he worked at. Jesse told my husband that he was going to kill him. He was already crazy screwed up as a kid.

I remember being called for jury duty and saying he's guilty all the way and having to sit in the court room with this crazy guy, I was creeped out by this guy. So glad I wasn't selected as a juror,
