Subway sued over short 'footlong' sandwiches

MOUNT HOLLY, N.J. (AP) - Two New Jersey men have sued Subway, saying the world's biggest fast-food chain has been shorting them on its so-called footlong sandwiches.
The filing made Tuesday seeks compensatory damages from the company and a change in practices.
Plaintiffs' lawyer Stephen DeNittis says the company should either make their sandwiches 12 inches long or stop advertising them as footlongs.
He said he's measured sandwiches from 17 area shops and not one has been 12 inches long.
Subway did not immediately return a call to The Associated Press.
The issue got widespread attention last week when a man posted a photo of a sandwich and a ruler on the company's Facebook page.
More than 100,000 people have "liked" or commented on the photo, which has the caption "Subway pls respond." Lookalike pictures have popped up elsewhere on Facebook. And The New York Post conducted an investigation that found four out of seven footlong sandwiches were shy of the 12 inches that makes a foot.
Last week Subwaysaid that the length of its sandwiches may vary slightly when its bread, which is baked at each Subway location, is not made to the chain's exact specifications.
"We are reinforcing our policies and procedures in an effort to ensure our offerings are always consistent no matter which Subway restaurant you visit," Subway said in an e-mailed statement.

Isnt there other more important things to worry about. Like WHO needs to be eating a "FOOT LONG" sandwich any way. It would seem to me that with so many OBESE people in the world we would want to sue for selling a foot long. From what I saw the difference in the length is so small it is hard to see without a ruler, so lets all ban together to cost a company so much money that they raise the price of the food, THAT WILL SHOW THEM WE MEAN BUSINESS!.
All businesses are short-changing consumers. I remember when Wheat Chex was sold in a 17.5oz box. Now it's 14, but same price, or higher:'-( Why should Subway be any different. They use to use Chicken cubes, now, just chicken flavored slices. It's sad that we pay so much and get short-changed:-(

Do you think the picture of the sub looks like it does in the print ads and commercials? They misrepresent their product--like so many others do.
 @Mark @tijohns    I say lets stop eating at any resturant that does not serve the food as it appears on the print add or tv commercial. We can show them we are serious about our demands by not spending money with them. BUT wait that would mean more home cooked meals and family diners, my GODDESS what was I thinking, Spend time with each other and learn about our kids just because the picture does not match what you receive at the store.
Time to get real people, not everything is perfect, so if you are one of the ones wanting to sue someone over an inch difference in a sandwich, maybe you should take a

2x4's are not 2x4 but they start out that way and after they are planed and shaped they are less. Same with Sub's. Once they are heated and they shrink they are slightly smaller. These guys have no case since due to construction and prep of the sandwich can change the shaps and size. Stupid argument. Stupid case. So much injustice in the world and this is the best these guys have to offer? You can't fix stupid.

I work at a Subway so I can confirm that the size of the bread depends on how long its allowed to defrost and proof (rise). Its still the same AMOUNT of bread so the customers aren't really getting shorted anything.

@Jasmine Girl , the law suit is over false advertising. when you get a bag of potatoes that says five pounds, there HAS to be AT LEAST five pounds of potatoes in the bag.
The size of the bread depends on how long its defrosted and allowed to rise, therefore the advertised measurement is APPROXIMATE. The amount of dough never varies, so the customer isn't getting shorted on amount or weight.
Sounds like this is their way of compensating since they don't have footlongs!

(at regular speeds). Let's file a class action suit. Let's go measure a quarter pounder and see if it really weights 4 oz.Â

A kids meal is 3 inches APPROXIMATELY. Employees don't break out a ruler every time they make a sandwich. You still get the same amount of meat, cheese and veggies. As a matter of fact most Subways give more veggies and sauce than regulation calls for so you were probably compensated somehow.

I was on my way to work and picked aup a guacamole sub. On the way i was in a hurry so i diddnt notice till later on my lunch break that they did not even put guacamole in it..but they sure as heck charged me for the guac..sigh
